Copyrights last 50 years... you have to contact the artist (Names in the brackets in the booklet/album sleeve etc..).Some will let use samples for free depending on what is and if you are some unknown broke college student, others want portion or a hefty amount and some just say "NO!".
You can usually get away with sampling on ghetto mixtapes and shit. I've already gone through the process of clearing samples legally, it can get frustrating.
