LAPD Shoot Unarmed Man Gesturing With Towel-Wrapped Arm
On Friday, LAPD officers shot a man who had raised his arm, wrapped in a towel, towards them, the Los Angeles Times reports. Police said the officers thought he had a gun; he did not.
According to authorities, the man, who has not been identified, was trying to flag police down around 6:30 p.m. at Los Feliz Boulevard and Tica Drive.
“This person extended an arm wrapped in a towel. The officer exited the vehicle and said, ‘Drop the gun, drop the gun,’” LAPD Lt. John Jenal said.
Motorists nearby took graphic video of the shooting’s aftermath: officers are seen to handcuff the victim as he bleeds from, apparently, the back of his head.
The man was taken to a hospital and is in critical condition.

According to NBC News, the City of New York has agreed to pay $5.9 million to the family of Eric Garner, who was killed by Staten Island NYPD officer Daniel Pantaleo a year ago this week.
“I believe that we have reached an agreement that acknowledges the tragic nature of Mr. Garner’s death while balancing my office’s fiscal responsibility to the City,” said City Comptroller Scott Stringer in a statement Monday evening, noting, “the City has not admitted liability.”
In October, the family filed notice of a $75 million lawsuit against the NYPD, claiming Garner’s chokehold death was the direct result of the police force’s “negligence, recklessness and carelessness.”
The death had previously been ruled a homicide by the city’s medical examiner, but Staten Island D.A. Daniel Donovan was unable to indict Garner’s killer for criminally negligent homicide or manslaughter and reportedly chose to leave out a lesser reckless endangerment charge for unexplained reasons.
A Justice Department investigation into Garner’s death is ongoing.

Newly Released Video Shows California Police Fatally Shoot Unarmed Man
Despite efforts by the city of Gardena, California to suppress the footage, a video showing officers killing an unarmed, seemingly confused man was made public on Tuesday, the L.A. Times reports.
Earlier that day, a federal judge ruled that there was a strong public interest in releasing the footage, rejecting the city’s argument that it had settled a lawsuit over the shooting for $4.7 million with the belief the video would be kept secret.
“The fact that they spent the city’s money, presumably derived from taxes, only strengthens the public’s interest in seeing the videos,” wrote Judge Stephen V. Wilson in his decision. “Moreover, defendants cannot assert a valid compelling interest in sealing the videos to cover up any wrongdoing on their part or to shield themselves from embarrassment.”
The video shows the final moments of Ricardo Diaz-Zeferino, who was killed by Gardena police two years ago. From City News Service:
Diaz-Zeferino was gunned down on June, 2, 2013, after police responded to a call that a bicycle had been stolen from a nearby pharmacy and noticed two men riding bikes. The victim approached the officers and attempted to explain that his brother had reported the bicycle stolen and that the two men were not thieves but his friends, according to the complaint. The lawsuit alleges that police shot Diaz-Zeferino eight times and that he laid on the street, crying out in Spanish “Hasta aqui llegue” or “This is the end of me.” Gardena police maintained the shooting was justified because the victim was acting erratically and reached into his waistband despite a command to raise his hands.
Attorney Samuel Paz, who represented Diaz-Zeferino in the lawsuit, told the Associated Press he may ask for a federal civil rights investigation of the shooting.
“I think it is really helpful for the public to understand why they would be willing to pay $4.7 million to settle the case when we were on the eve of trial,” Paz said. “When the public sees the video and other law enforcement agencies see the video, this is very much a criminal act.”

According to data gathered by The Wall Street Journalthrough public-records requests, the costs of resolving police-misconduct cases has surged for big U.S. cities in recent years.
The WSJ reports that the 10 cities with the largest police departments paid out $248.7 million last year in settlements and court judgments in police-misconduct cases, up 48% from $168.3 million in 2010. Those cities collectively paid out $1.02 billion over those five years in such cases, which include alleged beatings, shootings and wrongful imprisonment.
These large payouts are not only from recent cases, such as Eric Garner's whose death after being put in an illegal police chokehold recently cost New York City a $5.9 million settlement— but from resolving decades of old police scandals as well. For example, in 2013 and 2014— Chicago paid over $60 million in cases where people were wrongfully imprisoned decades ago because of alleged police misconduct.
The 'video effect' is very prevalent in the settlement of most of these cases.
In April, the San Bernardino County in California reached a $650,000 settlement when a news helicopter captured video of a sheriff beating up Francis Pusok. “They wanted this to go away fast,” says Sharon Brunner, a lawyer for Mr. Pusok. A spokesman for the county said the quick payout was made to avoid costly litigation.
There are multiple cases like this and the costs of police misconduct settlements keep rising. Cities like Alburquerque, NM lack to put more money into risk-management funds because it takes away money from somewhere else. A city councilor claims that “having to put more money into that fund to pay for the lawsuits has really been challenging.”
But does that really justify anything? With all of the lives lost due to the recent surges of police brutality in the states— what will it take to turn a new leaf and move forward with preventing future cases? We need the change now more than ever.

New reports have stated that the officer was only fired for entering the building alone. I believe, in TX, if an officer spots an individual engaging in criminal activity, he/she has to call for backup. The officer wasn't fired for killing the man who was in the crime of destruction.

Well I'm not exactly the right person to ask that question to since I'd encourage them to shoot me. Ironman said you deserve to die if you point a gun at somebody, that's just crazy. It's east to talk tough on for Internet but there's so many variables that go in to that situation that a blanket "you deserve to die if you point a gun" is extreme.

Deputy Filmed With His Knee on the Unarmed Man's Neck, Killing Him During Arrest
The death of 48-year-old Dallas resident Joseph Hutcheson has been ruled a homicide. Hutcheson, as shown in the video above, reportedly entered the Dallas County Jail to request help from deputies regarding his wife's behavior. According to the Dallas Morning News, Hutcheson was then bombarded by multiple deputies before being taken forcefully to the ground and handcuffed. At one point in the video, a deputy is seen with his knee pressed firmly against the victim's neck. Hutcheson quickly lost consciousness and eventually died.
The Medical Examiner's office ruled that Hutcheson died from "a combination of the effects of being restrained, cocaine, methamphetamine and hypertensive cardiovascular disease." Multiple witnesses confirm to Dallas Morning News that one deputy did place his knee firmly against Hutcheson's neck, with Hutcheson eventually losing consciousness after "kicking erratically for several minutes under the weight of the deputies."
The offending officers reportedly waited at least ten minutes before even attempting to administer CPR, according to Mashable. Sadly, this is not the first disturbing case of police brutality from Dallas. The nationwide problem, thanks to efforts from #BlackLivesMatter and similar groups, is now being directly addressed by potential presidential candidates. In recent weeks, both Bernie Sanders and Hillary Clinton have taken measures aimed at making widespread police reform an important element in their respective campaigns.

Video Shows Texas Cops Fatally Shooting Man Who Apparently Raised Arms in Surrender
Yesterday, San Antonio’s KSAT released a video of two Bexar County sheriff deputies fatally shooting a 41-year-old man who appeared to have his arms raised in surrender.
The video, shot on a cell phone by a college student, shows the man, Gilbert Flores, walking shirtless in front of a home and behind several parked cars. As deputies Greg Vasquez and Robert Sanchez approach—they were responding to a domestic disturbance call—Flores jogs into the driveway and walks towards the deputies with his arms outstretched. He then turns his back and walks away, disappearing out of the camera’s view behind a police SUV. A moment later, he reemerges, seems to exchange words with the deputies, and appears to raise both arms, as though he were surrendering (the camera’s view of one arm is obstructed by a pole). Seconds later—as Flores’s arms are still apparently raised—one deputy opens fire, shooting Flores at least two times.
Flores was flown to a local hospital, where he later died. Neither of the deputies were injured, and both have been placed on administrative leave pending investigations by the county sheriff and district attorney’s office.
“Certainly, what’s in the video is a cause for concern,” Sheriff Susan Pamerleau said at a news conference on Friday, according to the New York Times. “But it’s important to let the investigation go through its course so that we can ensure a thorough and complete review of all that occurred of the evidence and the actions of the officers.”
Pamerleau also claimed Flores assaulted a woman and 18-month-old child inside that house, and that the officers tried using non-lethal methods including a Taser and a shield before opening fire; the video does not appear to show the use of either.
Hummelstown, PA – Another cop has been cleared of charges for cold-blooded murder.
Officer Lisa Mearkle of the Hummelstown Borough Police Department was found not guilty of criminal homicide for the shooting death of 59-year-old David Kassick on February 2. Video has just been released from the Taser camera which was deployed before she fired two bullets into the man’s back, as he lay face down on the ground in full compliance with her orders.
The video of this cold-blooded killing by a maniacal cop, shown in full detail, somehow did not convince a jury that it was homicide. He had been chased down, shocked repeatedly with a Taser, fallen down face first in the snow, displayed his hands clearly at the officer’s orders, and then shot in the back twice.
Officer Mearkle had attempted to pull Kassick over for an expired inspection sticker, but Kassick fled to his family home, where he tried to run into the backyard. That’s where Mearkle ended his life.
Mearkle seems to be in a hysterical rage as she shoots the Taser into Kassick’s back. He falls to the ground, shouting and writhing in pain as police sirens blare. She applies the Taser continuously for almost 30 seconds as he was on the ground, while shouting for him to “get on the ground.”
He is, in fact, on the ground. She shouts, “Show me your hands!”
Kassick, face down in the snow after receiving 50,000 volts of electricity, holds his hands forward and says, “I am showing you.”
She continues shouting “Show me your hands!” as he is showing his hands, and then fires the Taser and two bullets into Kassick’s back.
Kassick shouts at the officer in disbelief during his last moments of life. Officer Mearkle continues behaving as if this dying man was some sort of a threat.
In the charge of criminal homicide, the arrest affidavit stated:
“At the time Officer Mearkle fires both rounds from her pistol, the video clearly depicts Kassick lying on the snow covered lawn with his face toward the ground, furthermore, at the time the rounds are fired nothing can be seen in either of Kassick’s hands, nor does he point or direct anything toward Officer Mearkle.” District Attorney Ed Marsico, in bringing the criminal charges against Mearkle, said that it appeared from the recording that Kassick was simply trying to remove the stun gun probes from his back before his life was taken.
This is one of the most egregious displays of Blue Privilege we have witnessed, made all the more depressing because a “jury of peers” gave the verdict of not guilty.
D.A. Ed Marsico should be applauded for attempting to bring a murderer in uniform to justice.
