Its down to the ref's mood. If the ref says he saw it, nothing happens, the ref eithe rhas to choose whether to look like a shit ref and admit he saw it and did nothing, or just say he didnt see it and let the FA deal with it.
The difference is that the referee with the Chelsea kick (forget who) waived it away, and from memory I think awarded the fould against Liverpool, the matter is closed. Not seeing it is different because there is still intent of action, or whatever it is technically known as.
That's why it is confusing and that's why it isn't fair because one which is worse doesn't get punished and one which isn't so bad does.
