certainly not
how do we even know what happened in this theoretical situation
we can basically assume that anyone with the most malicious intent is the easiest to blame
we can infer that the "soldier" and "insurgent" were trying to defend their own country and beliefs
the "soldier" didnt "sign their life over to the government" their life can never be purchased or stolen
the whole incident would be most likely based on chance. is chance to blame?
unrelated, would a fox be in the wrong for ending the life of a chicken?
should man carry out the justice? or should God?
there also isnt "blame" when forgiveness is in the equation
my only answer without being there would be that an entity of peoples (the government, other) forced these men, not physically, but mentally into an area where this event took place. people are to blame, the location is to blame, life and death are to blame, causality and chance are to blame.
