every execution can kill an innocent man, jurists make mistakes.

If someone didn't commit the crime, there is no way there is enough rock solid proof that they did to recommend the death penalty. You may get one juror that would recommend death when it is not appropriate, but the whole jury? I would say that is EXTREMELY rare, and getting more rare all the time with the advancements in forensic science and other factors like racism being less of an issue than years ago.
